oh .. i'm still trying to get it totalled. in 2 days it will have been 3 months since the accident. the contact at the insurance i deal with hasn't responded back to me today ... maybe its time to dial up the management chain.

Have your lawyer write them a letter. Also, are you suing them for loss of use, personal injury, or anything else? You have a lot of possible leverage, so go ahead and use it. You should have had the car repaired and back in your hands or totaled by now. They are taking advantage of you. It is time to get nasty, mean and demanding. They will drag it out forever if you don't. The nature of the insurance business is not to be "nice and fair".

UPDATE!

On Thursday, December 22 2005 @ ~15:45 Westfield Insurance Group decided to TOTAL OUT my car!

YAY for me ... i'm NOT getting it back!


and of course on Friday morning 9AM i was at the BMW dealership ordering my 3rd e60 530i .. lol.
same COLOR, same TRIM, same OPTIONS! exactly the same car!

Congrats! Trust they have been paying for a rental while they dithered. Time to get an agent that will work for you, as opposed to an insurance company employee. There's a reason to run all your insurance through one agent; when push comes to shove, they get to earn their commission and they should gladly do so as you are THEIR customer.

Luckily its not my own insurance that I went through. It was the company if the party at fault ... The concrete companies! My own probably wouldn't have totalled it out.

I had an accident with a Westfield costomer once. They were equally slow to respond (months instead of weeks or days...).
