I would have to disaggree... with the exception of the cradle malfunction and a couple of the other little things which I think were addons anyway, I've had the same list of work done on my 04. Once fixed they have been fine. Really they weren't a problem to start with except the CCC.

The list of work looks OK to me! It includes some normal maintenance work as well as some recall work done.
Looks normal for that car and I would not call it a problematic car in any way. I would go for it.

If I go ahead with this purchase, which would be the best aftermarket warranty to buy? I average 5-6K miles yearly and would own the car for 3-5 years.

I have a slightly different view. Most of the problems seem centered around the TCU. Telematics Control Unit. Also the CCC which is basically the radio. This may not be a bad thing. If the TCU has been replaced and updated software installed the car may have had the bluetooth enabled for the phone which is a great thing. Probably $1000+ to get done on your own. The "Assist" failure is a common reason to have the TCU replaced. A lot of people, including me, bought 2004 E60's expecting bluetooth functionality only to find that the "build date" was too early to activate it. Many people have gone to elaborate lengths to get a TCU replacement under warranty and most of the entries you posted are related to just that issue.
I wouldn't give up on this car.

I don't understand why everyone is saying to give up on this car. I'm not trying to argue here but I need some enlightenment.
I see some TCU problems which look like they've been fixed. I see scheduled maintenance. I see recalls (I've had all of those recalls too). The CCC malfunction was in 2005. The active steering malfunction was in 2004. The last transceiver problem was over a year ago. The A/C compressor was in 2005. All of these look like they've been fixed.
The last "problem" on this car has been close to a year ago (BTW, this car needs an oil change since the last one was close to a year ago). Buy the car and drive it for a bit. Take notice on any problems you might see, hear, or feel. When you bring the car in for service, have them look at all of those. This car had some growing pains but it was the first year of production and it looks like the problems have been taken car of.
My only beef with this car is that it doesn't have some sort of warranty (after the factory one expires). Try to get the dealer to give you a good warranty and I think you're golden. If not, at least get him to drop down on price enough that you can get a good warranty. The warranty will cost you around $3k-$4k so have him drop the price accordingly.
When you go to negotiate, make a big stink about the car's service history and how BMW's have high repair bills and see if he'll throw in a warranty or drop down the price. I think that'll work. He needs to get rid of that car just as bad as you want it. Also remember that it's a stick shift BMW and those don't sell too well in the Northeast. Winter is coming up too. I think he'll deal.
