Well this kind of suck balls... my friend called the place, and the secretary said that the owner (John) is out of town. So would be meaningless for me to go down today. Man... talk about my luck =(

Man - seriously, you have wasted a lot of time. Time to play a little hardball, find out what state they're incorporated in and call the local DA's office, get the local news station involved - they always have a consumer protection reporter, and definitely go down there.

Come on, man up and sic the cops at them. It doesn't matter if the owner is there or not. What they have done is criminal and the cops will sort everyone out. Go for it and get the media involved.

Good question. I'm not a lawyer, so it is hard for me to tell you what would be the best way to present your case to the DA, but I'm guessing you'd want to indicate that you feel like you're being swindled and explain everything that happened with as much detail as possible. I recommend you present all the documentation you have supporting your case - from all the papers that you've ever received from the dealership and down to phone bills showing how many times you've called them about this. If you have any witnesses to any of their shady activities, I suggest you take written statements from them.

Sorry I didn't check in over the weekend - I'm barely ever on the forums on the weekends. But I sure wish you'd have gone there whether the owner is in town or not - at this point, you should be figuring out if he's ever coming back, if he really is out of town.

I would start by calling the California Department of Consumer Affairs. I would also go to my local police station and file a criminal complaint for theft. You paid for something, they didn't deliver it. I don't think there's any need to hire an attorney. Trust me, when the police show up to arrest them, you'll have your answers really quick.

Thanks guys, I definitely feel like I have been lagging this as well. I just went to my bank to get verified re-prints of the check and money order I made the payment with back in May. My banker told me that they will have the pdf for me (since it's many months ago) today, and I plan to go to the police with it.

Well this kind of suck balls. I am sure a lot of you guys will be surprised, as I was just now. I called the police department and the fraud investigative unit, and they told me that basically, all that I have done right now is all I can do.

Any motor vehicle sale cases fall under the jurisdiction of DMV, and that they do not involve themselves in DMV Investigation Unit's cases (which I filed last week).

The detective basically told me that all I can do right now is wait. Wtf. We really have a stupid system going on here =(

I don't understand why the authorities can't do anything about it especially that the dealership is already in violation. Perhaps you can send a certified letter to the dealer stating the issue and that you didn't have a choice but to file a complaint at the DMV and the local authorities as adviced by your attorney.
