I would recommend getting a week 9+ production 2005 as it seems to have addressed many of the problems found on earlier cars.

I got my 04 545 (October production) used with only 10K miles, and the only things I really had done on it was to have a firmware upgrade (thanks to all the posts here on how to get the dealer to do it free) as well as Bluetooth activated. Car is GREAT!!!
I have had several minor things done under warranty coverage and was able to get my Bluetooth activated with a software upgrade only.
I believe you need an actual TCU upgrade to activate Bluetooth if you have a pre-03/04 production car. Someone correct me if I'm wrong.

But the rating for the E60 EuroNCAP is still only four stars,
the E M-B, Lexus GS and the Audi A6 are 5 star cars!
I had a hell of on battle with BMW Nordic about this.
It took me 6 months before they gave me a new car,
I just love my legs!
Their argument was that the car was too "stiff" and was
measured for harder impounds than that the EuroNCAP
test required...
US crash tests, after the modifications, did go really well!
But there's also the reminder of the updates done.
I have all the corresdondence and stuff on my work laptop,
but all the facts can be found on the internet.
iihs.org and euroncap.com

Not to keep picking at an old scab, but I can tell you that crash test rating never crossed my mind when buying my 545. If I was that concerned about the crashworthiness of the car I was buying, I would have been over at the Volvo dealership...
