It is up to a city or state to regulate or ban cell-phones while driving. There is no such law on a national level (and I hope there never is).

In DC, near where I live you must be on a headset or some kind of handsfree system. In VA and MD though, you can have the handset to your ear. I think NYC requires the use of a headset as well.

My Ride: '04 545iS 6 spd, bought new via eBay, 11/05; Blk/Gry, Cold, L7, PDC, BMW Rear seatcover for pets.
First "Bumwa" was a new 1971 2002. High performance 5s since 1987. Beamer motorcycles too, currently on an 07 BMW K1200 GT; also a Moto Guzzi 1000 SP III.
All of New York State requires handsfree operation. I went in for my BTUM install today. They have kept it overnight so that they could do a "Big" download/upgrade of the software. Not sure what version I'll end up with, but they initally told me it was only going to take a 4 hour download. Who knows? Maybe I'll even be MP3 ready....whatever that means.
