Perheps it will help you if all members of this forum sent an e-mail to the dealer, asking why they are misleading their customers?
That would be great but I doubt the dealer would even take notice.

What a nightmare. several things:
-if you didn't own the car when the accident occurred then it's not your problem(at least in the US).
-If the car is good, then get the best settlement from the dealer(cash) because I doubt they will find you another car based on their lack of effort thusfar and whatever extra a lawyer gets you; you'll pay back in legal fees.
Its a pity we don't have the same consumer protection laws like in the US. I am trying to get a decent settlement from the dealer but they have offered me half of the real loss. (US$7,500 vs US$15,000). Hopefully they will give a better response once they are served with a demand from a lawyer.
At this point I don't care if the lawyer gets rich as long as the dealer has to waste their money trying to defend a case that they will lose and then have to pay me out as well. (My estimated legal fees should not exceed US$1,500).
I have it on video that they acknowledge that the fault is on their side so I doubt I will lose in court.

You want action from the dealer; go to your local TV station with your situation.
Settle for what you think is right; nothing more, nothing less.
All the Best

Just be careful, the dealer lied first to you; the lawyer could easily be second.
Good luck and keep us posted.

Final update on this sad saga.

After many meetings with both the dealer and BMW SA the dealer has been forced to buy back the vehicle at current market value assuming that the vehicle had never been in an accident. This came about after I threatened to take my case to the press as well as getting a lawyer to contact the dealer. The press would have loved the case as I have video evidence of the BMW SA representative lying to me and telling me how "BMW hid the damage from the dealer on the motoplan system"... I wonder how they would have gotten around explaining that in an interview.

Anyhow, I have now handed the car back to the dealer and they have paid me.

The dealer has my car on their floor for sale at full price for a vehicle of its conditions so I assume they are not going to inform the next buyer about the accident........ or if they do say anything I am certain that they will make it seem like a trivial accident. I hope the next buyer does not get cheated like I was.

Due to the bad taste left by both the dealer and BMW SA I have now decided to buy a vehicle from a competitor brand. A sad state of affairs as I really enjoyed the car but my loyalty to BMW has been badly dented.
