To actually answer your question about a software update providing this functionality: I really doubt it. Software updates only address the car's functionality. This detection capability is almost certainly a function of the FLIR Systems PathFindIR system and its onboard (or associated) image processing. I just don't see BMW undertaking to do this in an offboard fashion with the CIC/iDrive system.

Watch the video again and press stop when you get the warning.
The pedestrian is still not in the lighted area in front of the car.
So there is plenty of room to stop, three seconds to be exact! That's plenty!

Also, in the last part of the video you can see, that the camera had the pedestrian in sight allready for quite some time.

If you're a speeder looking for cops on the side of the road with radar pointed at you and their car running, its very useful.
