Catalano v. BMW of North America, LLC
Any one heard of this, just got a letter from them. the US district court for the southern district of New York , a nationwide settlement has been reached in a class action lawsuit against bmw NA and bmw AG.It's for any model year 2004 to 2010 us model bmw 5 series purchased or leased in the US. the laawsuit alleges that certain electronic components stored in the spare tire well of the trunk in the class vehicles are susceptible to water damage, caused either by clogged sunroof drainage tubes or by some other means of water ingress.etc etc

I received the same letter today. There is barely any rain here in California, so I'm not even sure if my BMW has this issue. During winter times when it was raining, all windows from inside of the car were fogged. BMW technician assumed that there is a water in my car. Back then I tough it's a nonsense, now I'm concerned.

Got the same letter
I just got 2 of the same letters yestetday 5/4/2017. 4 months ago i had water in my spare tire pwheel well and i took out my RDC module to dry and it was working. But lately ive been getting the tpm malfunction alert everyday sometime during my driving it will come on then go off so i keep checking my tire preasure thinking i have a slo leak somewhere. A few days ago i pulled everything out of my trunk to check for water in the wheel well or anywhere. I went ahead and unplugged it and plugged it back in and reset the tpm from idrive but sure enough a big ole PING and it was the tpm malfunction. The crazy part is i went to the dealership to get new batteries for my key fobs and i stopped by the service desk to have my key read for recalls and i asked about that tpm issue and the tech said no recall and he had not herad about a tpm malfunction. Lo and behold i get home to find these letters in the mail. So hummmm.

Re
Got the letter yesterday, can't see any water issues during rain or washing, trunk is dry.
TPM error came up several times during cold winter days, this has to do with low temperature and not sure if there is a fix for it.

Catalano Settlement
We also got the notice this week and it is a bit confusing. If you read the details about the settlement (8 page document) item #7 on page 3 states a free inspection is available yet when you keep reading on page 4 this only covers model years 2007 to 2010. The heading on page one states the settlement covers years 2004 to 2010. In 2012 we replaced the Gateway/Safety Module. Does anyone know if this module is located in the spare tire well? I don't think it is.

I received my letter, read it, and discarded it. I never had any issues and one of the first things I did when I got my E60 was relocate all of the trunk electronics and enlarge the sunroof drain outlets at the back of the car.
