They can't prejudge anything like that. No official means of saying "if they wish to merge, we won't permit it" until the merger is presented for regulatory approvla.

I predicted years ago that both companies could not exist or barely even one. The total numbers of the subscribers will not support this biz.

There is no way the FCC can reject the merger. How can they reject a merger on a business plan that is going to be belly up when HD radio really takes hold?

It's not just the FCC but the FTC. Two very different creatures with very different views of a potential merger.

As for HD driving XM/Sirius out of business, I'm not so sure of that. HD is simply the medium through which the signal is carried, it does nothing to improve the content. Even if the signal is the highest quality HD, but the channels are still full of DJ's talking and commercials, I will remain a customer or XM/Sirius and give up a bit of audio quality for the commercial/talk free format. Maybe I'm in the minority on that, but only time will tell.
