Default This one will be a new one for many - advice?

I own a 2011 550i. Took it in for service today under warranty to the dealership for 'chassis stabilization malfunction.' Got a call a few hours later.

While the tech was driving the vehicle to assess the problem - he was sideswiped by another vehicle. Noone injured and other driver's fault (according to dealer). They are very sorry, but the vehicle won't be repaired for up to two months (new door and quarter panel, at least). They will of course provide a loaner in the interim.

My question: this car will now drop in value significantly due to the accident., so how do I go about engaging in negotiations to get depreciation on the vehicle? I figure it is worth 40 or so conservatively, but after this accident????

Any advice much appreciated.

Accidents happen ... but 2 months sounds like there was significant damage. I'd press for a cash settlement (high retail book as a minimum) so you can replace your car with one that hasn't been negligently* damaged. * Accident fault is an insurance factor. The SA may not have been at fault but the "were it but for" rule applies. Were it but for the employee driving a customer's car the accident would not have happened. This one should be easy to the dealer's lawyers to see their way clear to replace your car w/o causing you further harm.

Sorry to hear about the misfortune.
I would definitely try to trade the car for a similar car that you can have the dealer sales dept look for you.
You can also try to up grade the car but in any event, make sure you get at least 15% in deprecation value of your car.

All property damage should be covered by the dealer's 'garage keepers' insurance, or under the other driver's 'property damage liability' coverage, assuming that they are insured. Either way, you should be covered.

check the local statutes in your state (or in DC), as you may be able to pursue a 'diminution in value' claim.

you're going to have to go through the normal insurance claim route for this one.

the chance of the dealer replacing your car, or writing you a check for the full value of the car is about as high as me winning the powerball this weekend.
