My wife was heading to work from Irvine up the 405 yesterday and just as she entered the 405 from Sand Canyon, saw this disguised car. Being that I have trained her to pay very close attention to all cars, especially German, she saw this and immediately started snapping photos with her cell. In her words, she almost wrecked her 550i trying to get the pics, but she took three. Unfortunately she accidentally only saved one.
So while this is only a rear shot, is your guess BMW 5? You have to look closely and look at other photos from WorldCar Fans, etc to see if this shot compares. I see the placement of the single sided exhaust, the shark fin antenna, the trunk lid in relation to the bumper, etc and even with the dsguise, I see the F10.
The photo is small so you will have to save and open it in your own desktop viewer so you can enlarge and see it closer.

I answered my own question. After searching for other Spyshots, I found this one of an M5 but if you look at the disguise, its the same as the car my wife caught. My wife's photo not an M5 though.

When you look at the size relative to the other car near it, it is too large to be a new 3 but to answer your question about why a spy shot of a car already released. I would guess that maybe its because they havent done an official launch in the US yet, maybe?
