Oh, for the record, if they are NOT offering new car rates on it, it should be friggin CPO'd. I'd fight with the bastards - they're just shorting you the CPO because they can. If it was sold as "used" car, its used. But yeah, atta boy on keepin' that cheese though - lap dances for everyone on you, huh? 
j/k but try writing a letter to BMW FinSer and/or BMW NA about the CPO, they may just decide it is worth it to give you an exception and CPO the car to keep you as a loyal customer
