Are windows factory tinted?

My wife just got pulled over and ticketed for having illegal front tinted window on her E61. I bought the car used and the previous owner tinted the back windows but not the fronts. I have an invoice that confirms that.

As I wanted to make sure that I am in the right before disputing the ticket I checked the front windows with a razor blade and I found a film on the inside. Online the info is allover the place, so my question here is to Canadian E61 owners:
Are your front side windows tinted from factory?
Is there some official info I can take to court to dispute the ticket?
thanks!

Check your VIN with one of those VIN decoders, it should disclose "tinted windows" if it was a factory option.

No factory tint on my Canadian 2010 E61.

I have never seen it an option on the front windows.. any "factory" tint was applied by the dealership independently. Sometimes the glass itself has a higher optical density, usually <2% which is why you get a warning from decent tint installer they will make your tint combined to be legal limit. You might be able to go to court with a document proving you removed anything that was there, but unknowingly thought it was factory. Often a "fix it" ticket will be waived if the problem was fixed. Alberta, where I was born has zero tolerance from when I was growing up. Sure, you can get away with it, but if you're pulled over then you don't have much to fight about it. Once when I was younger the officer gave me the option to peel it off right there and then. I said I had nothing to do it with, he lent me his knife to pick the edge and start peeling :) No ticket was issued. I thought he was a douche, but now that I'm older I think he did me a favor instead of writing up the ticket.

No, your car did not leave BMWs factory looking like that.
