BaT does seem to have an embarrassment of riches with many more cars to sell than time to sell them, so they can get very selective. I had an 07 late pre-LCI manual E61 that I had converted to 2WD but was also denied by BaT. It had 190k mi so I can see why it wasn't accepted but figured the manual and RWD part would have trumped the mileage. I also had records from 90k as well as oil samples at every change from that point. I think they can essentially look for the cream of the crop, and at this point for a E61 is around 80k miles and in otherwise great shape - no accidents, etc. As ripp222 opined, there's not a lot of money in it for them so they allocate the slots to the really interesting cars that get people talking.
Hopefully Cars & Bids keeps gaining traction for a bit of competition. I've also been paying attention to the late model Discovery 2s (I'll eventually sell mine) and the ones on C&B seem to get good exposure and get close to 'top dollar' in the low teens. Obviously not the same market but I think the idea is still the same.
I decided to get back into an E61 a few months back so I spent a decent bit of time looking at what many E61s were going for and concluded that the E61 is not terribly desirable except to a loyal few. Many with middling options were in the $5-6k for anything over 100k miles. Most were sadly moved into the basic transportation category so the good examples are becoming a bit more rare. Adding in M Sport jumps the price up but you have to be prepared to wait to find the very few people that want to pay that much more for it.
FWIW I ended up with a Carbon Black/Black 2010 M Sport with ~145k mi, and was immediately reminded of why I love this car!

From an enthusiast perspective, I agree the RWD and manual should have trumped the mileage if you had complete repair records. That conversion is very labor intensive, perhaps narrowing the audience that would want 2WD... but that's what makes it all the more unique.
I did see a note that due to the volume of cars BaT is selling, auctions will now end 7-days a week.
In the meantime, it's fun to decide which E61 am I going to take today!
