What are the chances?

I would say your chances are very good.
This fellow just picked up one for $59k (2006 M5 with 14,000 miles).
And there are about a dozen 2006 M5s for sale now in the U.S. in the low $60s. You can easily imagine that those prices will be $5k less in one year.
And you can pick up this one for only $52k right now!
On the other hand, you could go for this $115k "show car" ... I'm sure it's worth every penny (NOT).

Thanks for the reply!!! My buyout on my 550 will be $42233.00, so its a no brainer to go for the M5.

As the M5 approaches 50K and the remaining warranty is less than 12 months, you will see many M5's at bargain prices. As long as you can deal with the gas mileage and a short warranty, go for it. As a pleasant daily driver with decent power and handling, I personally would keep the 550i, but that's just me.

Gas mileage doesnt concern me, because the 550 isnt much better. Either does the SMG or Vanos, because with
research I should be able to find out if any of those were a problem. The only thing that worries me is the lack of warranty. I cant beleive BMW would do this to such an expensive car, it really will affect there re-sell values.
