Having only just recently bought my new 535xi at that very dealership, I'll be watching this one closely. I've been happy with them but this will show what their true colors are.

In fairness, it is an insurance matter. Whose insurance is to pay? It seems to me that the dealership accepted responsibility for the care and safekeeping of the car while it was in the shop. That may be for the courts to decide. But the dealership should make sure that the owner is made whole, regardless.

yes the company is responsible for the employees actions i believe its refered to as vicarious liability.

there are no words to explain how i would feel at that time.....On the other hand it was also on the owner to get off his ass to go pick it up instead of letting someone else drive his car......

This dealership is close to where I live and I used to go there a long while back, but left because of the dealership joyriding my M5. Long story short, I found out the guy whos car was crashed was real cool about it and asked the owner of the dealership (one of the Hansel members) to just fix his car, not replace it. But, the owner was a real jerk and said they were not going to pay anything and told him to report it to his insurance company. Then the owner of Prestige Imports called The Press Democrat (newspaper) and told them if they run that story, he was going to pull all the adds out of the paper, which are quit a few because the Hansel family owns quite a few dealerships. What a jerk!! Glad they ran the article anyway.

Wow. If an employee for a company does something negligent then the company is responsible even if they terminated the employee. The employee represented the company at the time of the action. At least that's the way it is in Massachusetts and RI. I've had to terminate employees for conduct type of violations, but still had to scramble to make sure that we kept damage control on the situation in order to avoid the situation from getting out of hand! This guys insurance should not have to pay anything no matter what he agreed to. This would be all on the dealership if this were to happen around here. :thumbsdown:
