Thanks Joe and I appreciate the kind words Calton but BMW of North America is a client of my firm (I don't represent it but apparently someone else in my firm does in one of our offices) so I can't sue BMW.

My practice concentrates on representing (and defending) big companies and not suing them (unless the plaintiff we represent is another big company).

Now if only I can leverage that client relationship to get a nice discount on the F10 M5.....

Seriously though, when the amount of money is not huge and a consumer in New York City feels that a dealer had taken advantage of them, a complaint to the New York City Department of Consumer Affairs (copied to the dealership's General Manager and to the car company's headquarters), coupled with filing a complaint in small claims court is a good way to seek redress and get the dealer's attention. A dealership may not want the trouble of having to deal with that sort of problem (and hire lawyers and inevitably pay them more than the amount in dispute) and may very well compromise or give in altogether.
