I would see if you can do basic coding through NCS Expert:
- Open Coding Tool
- Open NCSExpert
- FileàLoad Profile – load Expertmodus (Offen) profile
- Click “OK”
- Click F1: “VIN/ZCS/FA”
- Click F3: “ZCS/FA | ECU”
- Select chassis (E60)
- Click “OK”
- Choose ECU – select “CAS”
- Click “OK”
- You should now have VIN and FA appearing. FA is VO code.
- Select F6 “BACK”
- Select F4 “Process ECU”
- Select module to process from the pop-up
- Click “OK”
- Select F4 “Read ECU”
- Window will pop up with .TRC file. Close it.
- Go back to coding tool and select “Load TRC-File”
- You should get a list of all settings available in the module.
- Use “search” button to find parameter. Click “Search next” until you find the parameter you are looking for.
- Select parameter value, for example “nicht_aktiv”
- Pop up box will appear to alter the value. There may be a tick box for a “quick change” from “nicht_aktiv” to “aktiv” for example. In some cases you may have to input the data, “wert_04” for example.
- Once value is changed, click “OK”
- Click “Save MAN-File”
- Click “YES” on pop-up
- Click “SAVE” on pop-up
- Click “YES” on pop-up: “Do you want to backup the MAN-File?”
- Click “SAVE” on popup.
- Go back to NCSExpert and click F2 “Change Job”
- Select “SG-Codieren”
- Click “OK”
- Click F3 “Execute job”
- Close coding tool
- Click “Yes” on popup: “Do you want to empty the MAN-File?”
- Done!

Biz77 it worked like a charm.. I coded the turn off legal disclaimer and it disappeared.
Just to be sure, I coded the auto eject key when start button held down and it worked too!
But... I now don't know the source of my error with the TCU flash..

And I'm afraid I can't be of much more help. I would wait for Ken to get back to you. My only suggestion would be to try updating all of your Daten files to the newest version.

Okay just one question about updating the Daten files...
So the instructions I got were to open bmwcoding tools, then update the sp-daten, then update the winpfk. This takes a few minutes, even hangs for a few seconds, but resumes fine.
Do I have to do this every single time before I open the winpfk to try the flash? Although I am pretty sure I did this and still got the error.. it's worth trying it again.
I also tried looking up the error and got a few answers:
1) the voltage of my car battery has to be above 13V .. ie I need to hook it up to a charger. This seems odd since nobody mentions I have to.
2) I need to change the communication settings in winpfk .. which I tried to, no luck, different errors
3) my cable isn't set to latency 1 .. but I have verified this over and over it is still com1 latency 1 every single time I plug it into the same port.

Once you update the daten files, they are updated. No need to do it every time.
I did not use a battery charger or any other type of power supply when I flashed mine.
Have you tried asking on bmwcoding.com?
