I see someone on EBay is selling an EGR bypass for the E60/61, does anyone have any experience of these and if they do improve running/ performance on the diesel models?

By bypassing EGR, engine will run hotter, ECU might complain, and, therefore, your engine life will be shortened.
Another thing is you'll produce more NOx due to high temperature in combustion chamber.

Nah, Engine will run cooler, cleaner and will pick up quicker. Also you wont be putting burnt fuel / soot back through the engine and causing loads of grit to be sucked through your engine. Not good.
Yes the ecu will show a CEL light.
