Yeah, its to do with the EU3 and EU4 standards. Cars up until about june 2004 had down pipes. After about june 2004 they added a partical filter to the diesels and the pipes were allowed to be straight.

I didn't like the previous standard one at all. Looked ugly and already started roasting after 6 months. The add costed me 350 EUR including the work as per catalog. Though
it took them much more time( a couple of hours) than previewed to have it fixed.

I do no think it cud void the warrantythe BMW garage which did it gave me an ACS certificate. I suppose ACS is producing it in accordance with BMW rules.
There are no black marks on the car so far as I have a black jet one hehe...

As an update to this thread - I eventually decided to switch my horrible dowturned
diesel pipes for a set of Hartge tailpipes.
Cost about GBP200 and took about an hour to have fitted. This involved cutting off
the curved portion of the pipes and welding on the new trim.
See attached pics - sorry for the poor quality this was taken on a cr***y ericsson picture phone.
I'm pretty happy with the results - the diameter of the pipes is fractionally bigger
that I would have liked but its a zillion times better than the dire originals.
If anyone's interested, the work was done by www.birdsauto.com (01895 810 850) who did a great job.
