Is 35% really not 35%?

I'm in the process of looking at tint and I'm debating on 20% vs. 35% vs. 40%. The shop carries only 20 and 40 in the line I'm looking at, however, the company does make a 35. I'm leaning towards staying legal because I don't want to have to mess with getting it passed inspection/worry about citations etc.
So when I inquired about perhaps ordering the 35% he stated that the 35% combined with the thickness of the glass will not make a legal passing window tinted vehicle. Saying, the measurement on the light meter will be in the high 20's and the company won't provide documentation stating that it backs the warranty. The shop will back the warranty, but I won't get a documentation card from the company stating everything is legitmate (legal?) unless I go with the 40% tint.
I'm afriad the 20% will be a little over the top for my taste and given that I have a black on black vehicle. I think I'd rather have the 35% over the 40% for looks and heat purposes, but I would think it would still be 'legal' in North Carolina. Any info would be awesome.

i did 35% on my maxima, when i got pulled over in GA where the law is 35%, i had it tested and they told me the visibility was at 37% which is legal by 2%. tell this shop to eat one and find another. i wanted 35 on my bmw, the shop put on what i wanted and they back it with a warranty. these douchebags are just trying to sell you what is in stock as opposed to ordering something.

Yeah, depending on the glass, most tint registers lower on the "tint meter" than the percentage you get. For instance mine registers at around 17%, but the tint is 20%. Most inspection stations shouldnt give you any trouble if its within a couple from the legal limit though...

Mine looks darker than 35%. I had 35% with a 5% layer added on it on my maxima. You could not see in the car at all. Had it for a year and never was pulled over.

i just had a tint done on my car recently. 20% on rear window, 35% on 4 door windows. since the rear window is darker, it give the illusion that the rear passenger windows are a little bit darker than the front.
