Not sure I understand your question .. .. but in addition to the 535 sedan we (USA) also get a 528 ... we do not have a diesel powered 5 series or 3 series here that drivetrain is only available to us in the X5 and interestingly that is still branded as a 2012 while all others are 2013. Maybe that has something to do with managing the inventory to help raise the Corporate Average Fuel Economy (CAFE) numbers I'm sure all the technology for 2013 model X5's is in the 2012 rolling off the assembly line at the same time.

I think the OP is referring to the 2008+ 535i (and 535xi?) fitted with the N54B30 engine (twin-turbo three liter). It appears to have been a U.S. market variant only.
I don't know the answer. However, for a variety of factors (production capability, marketing, customer expectations, local competition, emissions, etc.), not all variants are available in all markets.
Recent BMW U.S. 5-series model numbers have been driven by marketing, not absolute specifications. For example, the 2005-06 525i and 530i were both fitted with three-liter N52 engines, but with different intake tuning. Power specs, trim details, and prices were different.
In 2008, BMW improved the "base" N52 and increased its power. In the U.S., the LCI 5-series with this engine became the 528i. I suspect that that designation was too close to the 530i for marketing purposes, and the 535i with the N54 (twin-turbo three-liter) was born.
This approach may have made some sense. Introducing twin-turbo technology in the the U.S.' rather varied environment may have been a deliberate part of BMW's testing strategy for this technology, as limiting the market should help contain any "problems".
Or...???
I hope you find and post the 'real' answer!

Model year 2011 was the last 335d available after a 2-year run in the United States; No telling if BMWNA will bring it back to us since many dealers were "stuck" with inventory for many months. Many dealers unloaded them at deep discounts underwritten by BMW.
I also follow Jonathan Spira's blogs religiously ... and if you happened to notice my forum name it notes my FIRST BMW in 1986: a 1986 524TURBO DIESEL. That was a great car and served me and (one of my offspring) for 300,000 miles

On Europe, consumers focus more on what's the best value - diesel gets way more mpg than regular gas. Taxes probably factor into the equation too.
I actually test drove a 535d before I bought my E60, and I got alot of comments about the car being a 535i instead of a 535d.
