Vibration of the pad in the caliper? Apply some copper grease liberally to the rear of the pads. It's worth a shot.

Surely the dealer already tried that (it's good practice), especially if they changed the pads & discs etc.!

my gf's 335 have the same problem, we took it to the dealer several times. the first tech who took care of her car said that there are several customer complained about this whistling sound, he said that they can't fix it and just make a complain to BMW, I said OKAY, we left it alone. On our next visit,it's a different tech that helped us, so I complained about the whistling noise that was very annoying for car that is under a year old, so he took a look at it and said something about changing some bushings and the brake calipers hitting something at a sudden hard braking and they had to order some parts. okay we waited a week and a half for the part they need to order. now they called and us and said that the part is in. we brought the car in again, and at the end of the day we got the car, we were explained that the brake sensor is hitting something and it's what causing the noise. the noise was gone which was a relief but after probably a month the noise is back. it's not an everyday noise but it comes and go. now we have to bring the car back again one of these days to have it check.

3 times for the same problem is a lemon...in most states. Make sure the problem is indicated on the paper work so you'll have options should you decide to take the lemon law route.
