Your dealer is clearly wrong. I am in the US and I took delivery last weekend. My car was built 2/5. and mine works fine, so should yours.
If your dealer can't give you a good answer call BMW customer service at
800-831-1117.

As of January production there is a software upgrade available to make voice activation work!!
This is according to BMW service that I called today.

I have two. One next to the menu and the other on the wheel.
The cars that are prewired for voice recognition have both. The others have one on the steering wheel, which as far as I know will be functionless. Just like the phone button if you don't use a phone.
