Updating my E60 Software

Hi all,
i need to update the software for my 2006 525i .
i contacted the local official dealer and strangely enough, they told me that updating such an old car to the latest software may result in failure of some modules in the car, for example the CAS module, and if this happen then i will pay the cost.
my question is: would such problems happen? and is it true that i have to pay for anything that might go wrong during or after the software update?

it's very unlikely for things to fail, the only 2 things that may fail are the first generation MULF modules (if you have an SOS button on the roof you have a TCU module) and the other one is the CCC and that's only if it's not been stable already (restarting, shutting down, not booting properly). If it can stay on for 4 hours in a row with no problem then their should be no issue.
They say "it's your fault if it fails" but unless they make you sign a disclaimer they can't pass the bill on to you. Even if the car did fail, them telling you beforehand it might fail isn't a valid reason won't stand up in a court - you drove it in so you should be able to drive it out.
Software update is worth it for the automatic gearbox and any retrofits you may wish to carry out in the future.

How does one know if they need a software upgrade? Bought mine used at the dealer in Dec., would they have checked if it were up to date?
