Totaled or Repairable???
First glad you are ok. I myself am going to be a first time dad in oct. and its a boy. I sold my wifes m3 conv. and got her a 545 b/c I think they are very safe. Your car should total if it doesnt I will be suprised. If it doesnt total may sure they get as big a est. as posible and sell the car wrecked. It would have a good title and those cars with good titles are bringing alot of money going overseas. Dont let them fix it, well I wouldnt anyway.

Even though x-rays don't show injury, you may suffer some "soft tissue" injury that warrants treatment via physical therapy and/or massage.
About 5 years ago, my wife was rear-ended in her Saab convertible by a Hummer 2 in Laguna Beach. A VW Jetta was hit prior to the subsequent direct impact to our Saab - the Jetta was totalled. She had soreness in neck and back which was treated as above. We were 3 months from end of lease, and did not intend to purchase because residual was absurdly high and Saab Fin'l insured that value. Initially, they intended to repair the car, which I didn't want. I fought this for almost a month, to prove to the at-fault insurer and Saab Fin'l that the real market value of the car was $4-$5,000 less than the residual. They finally agreed to total the car, as repair cost was 60-70% of the real value.
The insurer (and you) also have to factor in the cost of renting a comparable vehicle for you during the repair period. It may be difficult to find a company that would rent a BMW 5-series, but it may be worth the effort, so you can show them that cost, as well. That could also add to repair cost and help swing them in direction of total.
Previously made point re diminished value is also an important issue to include in your negotiations.

I agree with you that insurance companies SHOULD total a car when it gets up to 75% of the value, but not all of them do. I have/had Geico.

Appraisal was done yesterday, I should have the estimate today. Fortunately, the other insurance is accepting liability for all cars, and my insurance is still taking care of my claim and is then going to bill his.
Ironically, my claims agent owns a 545, so I have someone that understands these cars.

They did a complete tear down already? Did they pull the engine?
Have you been down to see your car since they have had it? Amazing what the inside on these cars look like. It's no wonder they cost so damn much to repair.
