"Ins. Co. take months to finalize who's at fault."
In New Jersey, isn't it true that insurance companies have 45 days from the date of the claim to either complete the investigation or have a good reason why it is not complete? I guess that "good reason" addendum is a great loop hole for them to work with.

UPDATE:
I was supposed to get my car back yesterday, but the shop manager called and said they "ran into a problem." He said that "oil blew through the turbo charger" so it is going to take a couple of more days or so. I am not that familiar with the workings of any engine, but what he said certainly did not sound good to me. I am anxious to get my car back, but also very nervous. Somehow I do not think it will be quite the same.

The damage was likely not apparent until they fired up the engine.

So I get a call from the shop manager today.
He asked me how fast I was going when I got hit. I could only guess maybe 10-15 mph. He said that his reason for asking is they want to know if the turbo-chargers had kicked it yet or not. At what RPM does the turbos kick in?
He said that if they were not yet initiated then they should be fine, but they would not know for sure until they put the engine back in and fire it up. Needless to say, I will not be getting my car back this week. It has now been 9.5 weeks since the accident. This truly sucks! I wish they would just declare the car totalled so that I could move on!!!!

Beyond that, the fact they are broken has nothing to do with the fact that they were spinning.
