Thats normal for sports mode. Its suppose to do that. It holds the gear anticipating for when you're going to get on it again so the car can respond RIGHT away.
This was a big "advertisment / Press" thing at the BMWs Ultimate Driving Experience that I went to for the introduction of the E90. All the professional drivers that gave us lessons on autocrossing was saying how GREAT this is.

It was great news to me when my car started behaving this way after a software update. The sport mode now behaves more like a sport mode should. It should mimic what a manual would do (perhaps with a few niceties thrown in)--unless there is danger, for example, to the engine. Count your blessings.

Thanks for all your input. All posters were in agreement that steptronic holding a lower gear at high revs in DS is highly desirable. I agree as well, coming from two manuals prior to the E60. I'm using DS mode more than ever and really like it. Guess I'm learning about it too and will adjust.
As gas prices fall, my right foot gets heavier and heavier. Ah, a state of balance.
