Actually - they are. Model year production usually ends/begins in the spring. Thus you should be able to order a 2009. I'm pretty sure people here got their 08's as early as last June (Mine was in Aug 07).

Hmm, I just placed an on 6/9/08. From the paperwork, it still says 08. I guess I order the 08 or is it consider as 09?
Then again - E60 sales have been slow this year....
When I placed my order in early Jun of 07 I was told I could only order an 08.
