Parts will have to come from Germany, I'm sure, so 4-5 days just for parts.

Parts can take up to two weeks to get. Then usually a day or two is wasted to get you scheduled in. I'm assuming a good two to three days to take the old one out, install the new one, software, and testing. I think 5 to 7 days would be very good turn around and more likely 10 to 12 days. Don't be shocked if its 3 weeks. Make sure they give you a loaner.

My SMG car was like having a really hot girlfirend that sometime cheated on you, You didn't like all the problems but you do miss screwing around with her after she is gone.

Make sure they give you a loaner.
Fortunately I don't need it: I live in the center, I use the Mini in the city. With the E60 I go only outside the city (below 50-100 km trip I don't get it from the garage) .
Plus I prefer don't drive someone else's car.

BMW doesn't want to replace my gearbox due to the modifications I did (I think). USB port, bumpers, etc. .
And this is because my previous dealer I quarreled with must had signaled my car is modded.
Now I have to understand what I have to do with them.

If at the end I will have to pay for it, is there any reason to replace the whole gearbox instead of the sensor+actuator?
When the car is warm, all works perfectly. So why the entire gearbox?

In the USA the only way they can refuse warranty, is if the stuff you changed affected the part that broke. If you change your bumper, it doesn't affect the transmission.

Also here, in theory. I will have to go to speak at BMW Italy, at 15-20 km from here.
It isn't the warranty, I have a specified contract for service and everything for 5 years.
I hope they will cover the repair, otherwise I will go to the court, after analized the contract I signed.
If I will have to pay (because in any case I will have to repair the car, I need it working properly), I hope it will be enough to buy just the actuator repair kit ( Click )

In the US that is illegal unless the mod is directly the cause of the issue. I'd think that in Italy there has to be something similar. At that point they might as well say you got fuzzy dice hanging from your mirror and it caused the tranny to go out. Might want to get BMW involved if the dealer is being a pain to deal with. I'd find it hard to believe they'd turn you down.
Personally it sounds like some type of sensor, acutator, etc.. Like you said if it was the actual tranny broke it won't operate very well when you do get in gear. Functions normally after its warmed so it highly doubt it needs a complete replacement. I've heard the SMG tranny itself is very expensive. I thought I read on here at one time like 15K to replace. I'm not sure of the inner workings of all of it but just doesn't sound like the whole tranny would need replacing.

also since the mods are all bmw-oem parts (m-tech), there's no reason they can refuse because of that. It's not like you went and put on 3rd party ricer booster nitro stuff... lol

Alex... I hope you get the car fixed!! I just made it back to Germany and hopefully the 550 will be back on European soil in 3 weeks or so. I'm sure a trip to Milan will be in order for the spring time so we'll have to meet up for a drive!
