Thanks for the all the input. The insurance actually got back to me and they are going to total the car. The damage was right at the threshold (67%). The pictures doesn't show but there was quite some damage to the right frame rail. The initial estimate came out to close to 15k, being a MY04 its book value is prob 22-23k without options. Thanks for the kind words and inputs. I'll keep everyone updated with whats going on.

Nice!!!

But with $15K worth of damage? Even with a slightly pummeled frame that still seems a bit high for a rear end collision.

Don't be so surprised: My wife got rear ended in her Subaru Tribeca in March, to look at the outside you wouldn't think it would be that much damage, however, when you look under the car (the car that hit her was a Cavalier and went under her SUV) there was significant damage to the suspension and drivetrain. Luckily there was virtually no frame damage, but the total cost of repair was $12,867 to replace the rear suspension, exhaust (all the way to the headers), spare tire, rear axle, transfer case (it's AWD), and the rear bumper. The car is literally good as new now, but there was significant damage. The car was worth double the damage or they would've totaled t out ass well.

Great! This is the best possible outcome for you.

+1000, I, for one, would get rid of my car immediately if there's ANY frame damage, period. You never know if you get hit there again it will crumple MUCH worse and someone you love could be seriously hurt, not worth keeping IMHO.

Your insurance settlement should put you close to the market price for a newer model. Start shopping!

Yeah that's very true.

But i still have a hard time believing there is frame damage... i mean we're talking about a BMW here, one of the most rigid frames out there and for it to have slight frame damage from a rear end collision is just mind boggling

Depends what hit him, you'd be surprised what kind of damage an SUV can do to even a BMW. Truck frames are still much stronger because they're built for towing so they will definitely do more damage than say if he was rear ended by a Corolla.

WOW I find this hard to believe too, the pictures look like hardly any damage occured.

I'm only saying this b/c I was a passenger in a car accident a few years ago. My moms 545 was hit on the passenger doors. The glass blew out around the car, door pushed in and the frame was completely bend . Looking at it you thought for sure all passengers were seriously injured. Thankfully non of us were. her insurance company didnt total the car b/c replacing the glass, doors, frame damage and repaint came to around $10k... so they fixed the car at this 24hour repair shop my me and she was driving it within 2 weeks again.

I guess this guy is lucky so to speak b/c he can get a new car from this.. Who's your insurance carrier?!?!?!???

I must've misread or overlooked... but did he say exactly what he was hit by?
