I know this feature was added for MY 2007. If it is software based, I'm wondering if upgrading the software CIP version will add this feature to the older cars?

This feature is only available in NA through BMW Assist.

And to finally get around to answering the question, no it is not something that can simply be added with a software update. I have a Jan. '04 build and have been back and forth with BMWNA over this. Can't be done so I dropped BMW Assist...

Thanks for the answer! I've got comfort access and I've got this vague feeling that someday I'm going to be locked out of my car with no key. Anyone with MY 2007 and later have a good backup plan.

What MY is your car? With Confort Access you should be a new enough model year that has this ability though as others have pointed out you will have to pay for the BMW Assist service. It should be fairly easy to sign up if you don't currently have it. I want to say that BMWNA cars started having the remote unlock functionallity in MY 2005, MY 2006 at the latest. My MY2004 car cannot do this but if yours is a MY2007, yours should.

I don't think it's possible to lock the car with the key still inside. Certainly with the Lexus and (I think Audi) equivalents that is the case.

I suppose there's one way to find out.....
