DME changed, thermostat changed, water pump changed, might as well change all the hoses and expansion tank. LOL. Wow. To this point, there shouldnt be any hardware issues unless the engine internals for the cooling is at fault. I think they should also changed the ambient temperature sensor JUST IN CASE. I hope you can resolve this ASAP. And BMW should definitely give you back something. Not just a loaner and have fun. Keep talking to them. You need to argue. Nice pic BTW!

jesus christ! thanks for not believing in me, well like i said this is my first forum im not too skilled at it but here is a link to my photobucket i made the album public...its just pix of some the work i have documents for...and notice my name on the docs is christyna =] i had the 2011 loaner, and now since my last post they have put me back in a 535gt. all the work that has been done at rasmussen i dont have copies of yet (supposedly their mailing it to me) their the ones that have replaced the dme.
http://s87.photobucket.com/albums/k141/xasianbebex/bmw/

and for the ones that have believed me...thanks =] and yes i still dont have my car i was in there a few days ago and they now say that as of last friday the temperatures are now cool and where they need to be but when the tech test drove it out he literally turned the corner and the "engine overheating pull over allow to cool" popped up on the screen again. and to be honest now that theyve put me in the gt im not that bothered...with the amount of miles i rack i guess ill keep racking on theirs. basically yes ive given up the fight. but for you skeptics if you really wana get a feel for whats going on with my car...888-314-7410 is the dealership where my car is, knock your self out and find out they have had my car for as long as ive said. and they still dont know whats wrong.

Thats a lot of work done.

Christyna, in my opinion, if they are working on your car, let them take their own sweet time. In the meanwhile, keep driving those loaners. One day, they will want their loaner back and will need to give you a fixed car back - I am sure they are as eager as you are to fix this. They can do better than what they are doing, but it is a sucky situation for both parties.

The more time it takes, the more likely the dealer will also get fed up and figure out how to work with BMW to fix this for themselves, and for you.

Once everything is fixed, then you can DEMAND for more warranty, compensation etc ... ... don't be harsh on them until then. Be persistent (read passive aggressive) and keep checking every 3-4 days. When you speak to them, ask them when you should check back and who you should talk to. Tell your SA that you will keep a written or recorded log of the conversation for warranty claims later - but don't sound cocky. If you are in a shitty mood, ask your SA sarcastically if there is an attorney that he would recommend to help you deal with fighting your case with BMW NA? That will give your SA nightmares because he will know you are serious about the legal proceedings.

Your car has a history of overheating all the way back to 8,000 miles and seems to have become worse later on. I am curious if this dealer has charged you the 50.00 fee for each time you taken it back in for an overheat? I believe there is a deductable for the repair on CPO and the original repair is covered for two years. You take you car in because is says it's overheating, it up the techs to determine the root cause of the problem and fix it. When you return a while later because the car is overheating again and the techs now says it something else I would not be willing to pay for a new deductable. I would argue that fact that the failed to properly diagnose the problem to begin with. As many times as you have been back, these fees would have added up to several hundreds of dollars out of your pocket and still the problem is not fixed.

I believe I would start to forget about fixing this and focus on trying to get them to take it back and get another e60 through them. They could take this car to a auction and try and unload it there. At a minimum you are doing well though, with a new loaner car. The only problem is when you get your car back it will probably feel strange since it won't drive and feel like the new one you are using.

+1. I do not agree with not being demanding or harsh. You are getting nowhere because you aren't. That is the way to play it at the beginning. Game has changed. Insist on collateral swap at this point. If you are anything like me (and apparently tonyb635) you will never feel like it's the same car. Call BMW Na right away. Don't give up. That makes it far too easy on the dealer to not prioritize your car. I am one pain in the a**. I'd have already been there on a daily basis telling them I want an upgrade on the swap. You want me to come down there?! -hahahahahahaha

well i never thought of that "not driving like the new cars they've given me" all i think is i miss my car =[ but that makes sense especially after driving the GT's they've given me i feel like I'm flying in them. i haven't heard from bmw usa since the last call i got weeks ago (probably because i ended the convo abruptly) . i believe since I've had the car I've had 2 deductibles of 50 each...after that they considered it a "reoccurring issue" so the SA would waive them even at the prior dealership...and of course at the dealer I'm at now they've never charged me one.

The only thing that scares me about "collateral swap" is from what i googled about it..they'd basically swap me for a car of equal value? is that correct? if so back in april i entertained the thought of trading because of the issues and the guy told me trade value would only be 17500 because i have 95k miles...so my fear is they'd want to put me in a 3 series? which I'm not a 3 series hater we have an 07 328xi in our garage as well but i def want a 5.

monday i shall call and ask for an update...as of the 16th of july they were basically at ground zero with no idea again.

No. You insist on a similar car with similar or better features. Listen, you are obviously a very sweet and sensitive person (now if you do turn out to be a 500 lb trucker after I said that I will drive out there and bunch you..lol) but it is not getting you anywhere. Honestly, the reason some people on here did not believe you is because this is bordering on unimaginable now after this amt of time. Fact is, strong willed personalities prevail every time. Stop worrying about " what if they dont do this or they do that"). Screw that. You dictate what you want. You deem what is fair and demand it. If you can't do it bring a friend who.can. if all else fails get some leverage (ie: letter from atty.). If you are "waiting to hear from BMW NA or the dealer" you are not going to get anywhere. Look, I train brokers on this stuff for real estate when dealing with banks. It works. Doing nothing gets you nothing. Persistence gets you everywhere. Just suck it up and take a little action outside of your comfort zone.

Got the call today!

So supposedly tomorrow i get to get my car back.

They've replaced the oil thermo sensor and are confident that was the problem.
