I did find this video.
"You can see how to program a BMW smart key for CAS system for 10 seconds via OBD II without disassemble anything from the car. This is a genuine tool and it's not a Chinese copy!"
But, Id still recommend taking it to the dealer, as they seem to want 9000 Euros for the programmer.
The point is, however, (that if this is true,) the keys simply work off RFID technology with the transmitter for other commands. So it should not be any more complex than pairing a different key (new or used) with the car.
Ok, there's more information here:

It certainly isn't something simple to accomplish without extra hardware, and possibly the correct replacement keys.

$250 - $300 seems about right for a replacement comfort access key.
I wouldn't waste any time trying to get a deal off Ebay. The keys have to be ordered from the factory, which is why you have to show proof of car ownership. The factory keeps a database that links every VIN to some sort of specific algorithm that gets loaded into the key. Some dealearships have access to this dbase and can program keys, otherwise they get programmed at the factory. You can only program so many keys per car - once you exceed a certain amount you have to replace the entire igintion.
Years ago some people working at a MB dealership were duplicating car keys that were dropped off for service and selling them with the owner's address to thieves, who later on would steal the cars. Since then tighter control measures are used. Now you have to submit ID so in this case, BMW knows you are the registered owner of the car. If you bought the car used you have to show proof of ownership so they can update their records.

Well... I ordered the key yesterday and the price was good, however while I was there, he in stated that even though the key will work to open and start the car, the comfort access still has to be programmed at one hour shop min. He also said to get hold of him during my next maintenance, and he'll try slip it in.
The moral of the story is don't lose your key!
