The BMW Nav drives are pretty fussy about the disks they will read. I also think that the drives vary in performance. My drive works very hard to read anything.
Dual layer disks are harder to read than single layer disks and newer Nav DVDs have to be dual layer to fit everything in (about 6.7GB for 2009-1 Professional).
Copies (backups) of dual layer disks are notoriously hard to produce. You need a good DVD burner, the right disk the right settings etc.
Having said all of that if your DVD is an original one in good condition and the old disk works fine then your problem is that your iDrive software needs an update - which has to be done by a BMW dealer. That should take an hour but they have so many problems doing these software updates they like to book the car in for 2 days!
Note that the genuine disks don't have full postcode or speed cameras on the DVD. People edit the original disks to add in this additional information (well copy the original DVD add in the data then burn to a new DVD). Some even remove languages other than English so that it all fits (just) on a single layer disk.

unfortunately only the dealership can check your software level, latest i think is ISTA v35 or v34, it can take up to 7 hours as the new ISTA system insists on updating the whole car, on
a basic e60 there's at least 60 different computer modules hence the long upload time, latest nav disc is 2009.2.
