Hello,

I bought my first ever BMW a couple of months ago and already it has been in and out of the dealership 4 times. The dealer eventually had to replace the transmission, crack vent valve, retrofit the moonroof (slamming problem), replace the door sills twice now (it still creaks by the way), and fix rattles and creaks at the hood. Twice I had to bring it back to the dealer because they did not put the car back together properly. Once after they replaced the transmission it did not recognize when I shifted to DS or manual mode and another after I found out there was a half inch gap between the hood and the windshield by the windshield wiper, outside the car.

Yesterday, I started hearing a loud click under the driver side seat every time I hit a stop. I am very disappointed because a lot of these problems are on the BMW checklist for CPO cars. Makes me wonder whether the dealership actually ran the car through the checklist and if they did, this would make me question the reliability of the car.

At this point I have decided the time that I spent in and out of the dealership is not worth it. I have two very young kids and a demanding job and I have lost so many hours at work already. So I decided to get rid of this car and either get another E60 or a different brand altogether. I know this will set me back some and I would like to minimize that as much as possible. I am hoping you guys could chime in your ideas and recommendations.

can you give us detail to where you bought the car from? how much mileage did it have on it when you bought the car? if it has been couple of months, perhaps you need to talk to the GM or BMWNA to see what they can do. After all it's a CPO car per what you are saying. If it's CPO-ed then shouldn't these things been checked against? If you have email, post it, so i can send you the CPO checklist. Or actually you can get it by search on the forum.

Definately I understand time is a big issue. Hectic work schedule, personal life and car stuff together is a lot to handle for anyone.
I am sorry you have had such troublesome period.

Best of luck, sir.
Maybe it's just the car that's bad. There are a lot of happy and satisfied e60 people here.

What model do you own??

Sorry to hear about all the issues. These cars are usually are pretty realiable with little to no issues or they can be a real pain in the butt (had a 7 series once like that).

Talk to manager and see what they say. Also there is lemon laws to look into also. I'd think enough bitching at the dealership you could get something worked out with them.

The car is an 05 525i sport. Bought with 36.5k from South Bay BMW, it's now at 39k.

Thanks for offering to email the checklist, I actually downloaded it from one of the threads here. That's how I found out a lot of the problems I am experiencing SHOULD have been found if the dealer actually ran trough the checklist.

I understand there will be problem cars with every make. Buying another E60 will depend heavily on how much I will need to spend and how much support I get from BMW NA. I don't want to get another E60 and end up in the same situation if I don't get enough support.

In any case, how much do you think has the car depreciated and how much am I screw*d.

While your situation does not qualify as a true "Lemon Law" case - the analogy is pretty clear. Under Lemon Laws - they will either give you a new car or refund your purchase price minus a depreciation factor based upon mileage. You can look to your state's Lemon Law to determine the formula.

If I were you I would ask to trade in your E60 for a different E60 that you are comfortable with - and ask that they credit you what you paid for your E60 without a set off for depreciation.... . Your fall back position for bargaining should be to accept a set off for the depreciation.... but given the aggrivation and time you have spent - they should be willing to take care of you.

And I say stick with the E60s.

Lemon laws vary by state. Without knowing which state your reside, i can't comment on this matter.

However, if you are looking to do a switch. I would say get a 3.5RL Acura. I love that car with SH.

How much have you lost or screwed is going to depend on how you are going to sell it, privately or trade it in.
if you trade in, i think it might roughly be about 6k. Since that is the spread i see between Manhiem vs. dealer listing/selling.
if you sell privately, you maybe in the 3k range.

It's all depends on option, condition, local market, local supply/demand etc.

GL & sorry to hear about this issue.

I would appreciate that since I just got the car back again from the dealership today.

The steering column creaks while adjusting and the driver seat clicks/creaks when coming to a stop. They had to replace the steering column and the driver seat rail.
