My 2005 BMW 545 sad story (part 2)

Last month I described numerous issues I had with my 2005 BMW 545. Here is the link to it:

It ended with my car being at the dealers shop for 18 days with no resolution for the engine problems.
Now I would like to tell you the rest of my story. It is long but funny. Please read and advise.

The very same day when I posted my original message I got a call from the dealer informing me that my car has been fixed. I picked the car up next day and it drove great. I was very happy for about 2 weeks but on Sunday, July 23rd the dreaded "Engine malfunction. Drive moderately" and "Emission failure. Service Engine soon" lights came back on and my car almost stalled at a read light. I was able to get home but the engine lost most of its power and kept vibrating on the way back.

I called my dealer next day and was told to bring the car in. Unfortunately I was too busy to do and next 3 days I drove my girlfriend's Maxima. On Thursday, July 27 I finally took my car to the shop. Over there I was told that the dealer is very busy and no one will be able to look at my car until sometime next week. I got my old friend Cobalt as a loaner and while driving to work kept thinking that there is something wrong with situation when you pay for a BMW 545 but drive a Chevy Cobalt. Anyway the real fun began next day.

In the morning the Cobalt refused to start. I called my dealer and they transferred me to the Enterprise office onsite and promised me that I will get a replacement car very soon. 1 hour later the Cobalt was towed away and there I was with no car at all (my girlfriend was visiting her parents). I called Enterprise again and was told that the only car they have available is a pick-up truck that I refused keeping in mind that next day was my shopping-with-my-mother day and that she would not like getting in and out from a pickup. 4 hours later after numerous calls to the dealership and several Enterprise offices I've got a replacement car and this time it was a 2004 Mitsubishi Lancer with almost 40K miles on the odometer, a very strong smoking odor inside and a hole in the carpet right where my right food would reside. I am enclosing pictures of that car since nobody usually believes me when I tell them this.

Anyway to make this story short I called my dealer on Tuesday, Aug 1st (repairs not started yet), Friday, Aug 4th (told that the problem is deep inside the engine, parts ordered, cannot tell when it will be fixed, loaner upgraded to BMW 330), Today, Aug 9th (the story changed, no major engine work, just some harness/wires needed replacement, work has been done, problem not solved, will contact BMW, no resolution date can be promised).


It is interesting that at the same time I was talking to BMWNA but the gentlemen on the phone though very nice and apologetic was not able to help me so far. According to him he is trying to convince my dealer to buy the car back but they are not willing to do it. He keeps telling me that there is someone else who could force the issue through but that person is on vacation or is not available and so one and so on. I feel very uncomfortable with the current situation especially with the fact that the dealer changed their original story about the latest problem. It could?ve been an honest mistake but I suspect that they lied to BMWNA to make the case look less serious. On the other hand it does not make much difference to me what exactly is the problem; I've been w/out my car for 14 more days this time (56 calendar days over the last year) and the fact that the problem is less or more serious does not change anything for me.

Please advise the best future actions. If I am not mistaken 3 unsuccessful engine repairs should qualify for NJ lemon law. Is it now the time to hire a lawyer?

You my friend are way to nice, I would have had this car replaced by now. Ask your service rep when the zone rep will be back form vacation and when he's scheduled to be at your dealership, you can also speak with the service mgr at your dealership since he has to initiate a buy back. If you do not get the right treatment, then find yourself a highly recommended lemon law lawyer, remember do not use your family lawyer.

I have owned/leased 5 BMW's in the last 6 years, and have a few issues with two of those cars, BMW took very good car of me and I never had to hire a lawyer.

On the process of trying to get rid of my g35 under californias lemon law warranty! unmistakable brake shake when i apply the brakes. i ve been wasting my time and tired of getting the rotors changed everytime, so i decided to hire a lawyer! if all goes well, 6 er here i come

If i were you i would force the issue into hiring a lawyer. A friend of mine had the similiar problem with his Subaru. His car has been in and out of the shop 3 times with the same problem. The Company could not find the problem and the third time it has been in the shop for more then 20 days. In conclusion my friend took them to court and won the case which had caused the dealer to buy back the vehicle. Please keep us updated. Honestly, your going through a hell alot of bullshit. PLease keep us posted.
