Well right before I pulled in my driveway the Increased Emissions warning light poped up and the service engine soon is on now... I have only about 4800 miles on her...
I called BMW they said sometimes when filling up with gas they don;t tighen it good enough and sometimes there air pockets... he said unscrew the gas cap then twist it back till you hear the click and within a day it should reset itself...
Anyone ever have this problem?

I had the same thing, but it never reset itself. Went to the dealer one Saturday, luckily they were not very busy and the service guys reset the computer. Took about 15 minutes. Mine was around the same time, 5,000 miles or so, but it has never happened since (now 8,000+ miles).

It happened to me during christmas. I have to restart the car.. and the warning gone. Is this alright?

This was a well-known problem back when I took delivery in March 2004. The "Increased Emissions" warning typically shows up between the first 1500 - 5000 miles. Back then a software upgrade fixed it for most people, but I'm surprised to hear that it's still a problem on newer builds.

Seriously doubt it. Re-tighten the gas cap and it should clear itself. Might even take a tank or two of gas. If you have any doubts, call your service advisor and see if you can spin by and hook it up to the computer for a minute.
