I think you will find it to be much easier said than done as the 2008 535d will struggle with the emissions requirements. I don't know if there are ways around this, it may well be possible, but I can't imagine it would be either easy or worth it. If I were you I would look at a US model 335d or wait until BMW brings the F10 diesel to the US. It appears that the likely candidate will be the new 530d, but BMW may surprise us with the 535d. Either way, I would suspect it makes much more sense to get a model that was designed and built for the US market, either a 335 or an X535d.
