it's still 150co2 in emissions, the exhaust is cat back from the mid pipe,so legal!
i'm still running the exhaust in, the filling settles after 3000km, so from now till then the sound will get more aggressive.

if yes then it is legal
if not then all parts you get to upgrade from out side MB is not legal, even it is made buy MB, unless that shop is a MB altherrise seller

2009 should be a facelift one and xeon light should come as a standard wor (correct me if i am wrong).
Since F10 will be released on 2010, so BMW wants to sell all E60 stock in 2009. Normally, they put many things (options except sport package) into a standard one and provide a very attractive price.

Well I def didnt pay US$350 either! I paid less than $150 i think... cant quite remember!
