sorry to here this well I dont know which garage you went to buy I would not go there again because they are bull $hitting you.
the head light should turn off when in daylight.
I would get it fixed from the seller if you got the car from a 2nd hand shop.
BTW what years is it 2004?
how many km has it done?

Mine baby is made in 2005 Dec and first register in 2006. When I bought it, it was just 38000KM. However, I have to change the suspension cushion on the front because there are some funny noise coming out. After changed the cushion, it becomes a very quiet horse now. In addition, I have changed the new tires, using BS RE001...good!
By the way, I have a friend who brought a brand new E60 in 2008 and he has the same problem with me in auto headlight. He has went to BMW service to fix it but the result is the same!!! Means no fix. Also, I see many BMW turned on headlight in daytime and I think they are facing the same problem.
Any more share?
