My Ride: 2008 535xi / Platinum Grey / Black leather / Step Auto / Sport / Premium / Cold weather / 18" wheels / Logic 7 / Comfort / ipod / Navigation / Fold Down Rear Seats / Rear Airbags / Sirius SAT / Spoiler / Extended Clear bra / Bluetooth. (Previously owned a 2002 sport 525I Loaded).
On order: 535xi Platnium Grey with Black interior, Step Auto, Sports package, Premium package, Cold weather package, 18" wheels, Logic 7, Comfort access, ipod adapt, Navigation, Sat radio, Rear spoiler, Extended Clear coat bra.

Is this correct, BMW is telling me that the payments I already made on my 1st car is not incorporated into the 2nd. They further stated that the car has been used and depreciated. My position is that the car was problematic from inception and approved by BMW NA to be switched so the payments should be in incoporated into the loan and the loan continue as is. They are saying that the loan starts new all over again with the new car.
Is this the common practice and is it legal? I have to bring the car in this afternoon and need some opinions asap.

For leases, BMW normally does a collateral swap where the lease continues.
I had understand that loans are treated differently and sometimes are closed out.
Are you dealing with the dealer or BMW NA? Also, what were the problems with the car, just curious.
