Got rear ended...

November 29, 2009..

It all started when I went to class and I realized that I forgot my cellphone. After I got off class I was on my way to pick up my phone. I was at a complete stop and BOOOM.. I got rear ended.... It was minor damage and got all the info exchanged.

A month later when I contacted their insurance they had told me that their insurer said she was hit from behind and that caused her to hit me. I'm like OMFG!!! That is complete bullshit.. I was thinking OK I'll let my insurance GEICO deal with this non-sense, it should be no big deal they will go out and inspect their "REAR ENDED" car for damage.

Fast Forward to today..
Over the months that had past i had called for updates, the other insurance party kept telling me they're having trouble contacting their insurer. When they finally came into contact with her, she said she had SOLD the car and they couldn't find the car to have it inspected, and they will only accept 50% liability on this claim.

What makes me even more pissed off is that after I had contacted my insurance company GEICO.. they said if 50% liability is what they are accepting for then we have no choice but to accept it.. That means I will have 2 options either pay for the %50 of my deductible or %50 of the total repairs.

I'm thinking this is total bullshit I shouldn't have to pay for ANYTHING.. I was REAR ENDED..

Any advice??

Easy answer, get an atty if you don;t already have one. Should have spoken to one when it happened. My wife got rear ended last year, I called an atty the same day - they took care of everything (which was nice since the guy that hit her had no license and no insurance). Good luck

i guess you didnt get police report

either way, she was rear ended or what, she is responsible for your repair
get attorney, they like to handle auto accident cases

next time in situations like this , you better have a police report , better be safe than sorry. good luck with your case.

sounds like your insurance company is not too helpful either. i'd ditch them.

All these insurance companies are in bed with each other. Most of them won't press each other if they don't have to...keeps ALL their cost down if they can get us to pay. Don't rely on your insurance company to protect YOUR interest. That is not what they do.

Contact your insurance company in writing and advise them a complaint regarding the handling of this claim will be filed with your state's Department of Insurance and the Better Business Bureau.

In most states the liability in a case like yours rests squarely on the person who rear-ended you - regardless if they were first rear-ended. If that was the case, the person who hit you and his/her insurance company would be responsible for chasing any 3rd parties who may have caused the accident that caused your damage.

Geico, like most insurance companies, is most interested in mitigating THEIR losses - NOT YOURS!

Put ALL complaints in "writing" - by writing I really mean email; it is preferred and more efficient!

That sucks man, I would think legal action would be the next recourse.
