Are 5ers currently being delivered in the U.S. (non factory delivery) with a First Aid Kit in the toolkit?

AFAIK, yes. I have one, MY2008. Build date 11/07, delivery 12/07. But what do you mean by "non factory" delivered, as in EU delivery?

Non factory delivery means you didn't pick it up at the factory delivery center, i.e. the BMW Welt.

Danke for the infos.

I was under the impression that BMW was going to discontinue FA kits. Just curious...

I thought I saw a bulletin saying that the First Aid kit would be gone with MY09 cars.

Also the sunroof tool bought it with MY08 cars.

De-contenting. Wonderful.
