Dinan software install FAILED - 550i

I recieved no the best news today from Dinan. Apparently the latest BMW softwar won't allow for inital Dinan software loads unless you send in the DME to Dinan. Once the DME is programmed at Dinan's office the local dealer can apply the higher stages themselves. The other gotcha is if I need a BMW update then I'll have to resend the Dinan software again.

Is it too risky for me to remove the DME myself? Any ideas where it is located and should I take the battery out?
If it is too risky and I should have the dealer remove it should I hold them to the .5 hour labor charge agreed upon by Dinan and BMW?

It's located on the passenger side under the hood.

(1) pop hood
(2) remove the rubber lining and plastic piece closest to the windshield
(3) the ecu is under that.

it's pretty straight forward just a pain to get to. i'd disconnect the battery

I've heard from a number of people that I should never let the battery drain. Why is that?
By me unplugging the battery will that cause issues?
