Did the airbags go?
That seems like such a bad crash that the front helpframe could be damaged.
Is you E60 with the M54 or the N52 engine.
If it is the N52 it will be even a more expensive reparation.
Can the drunk fu**er pay?
No insurance will pay his/her crash!

good to know youre alright. sorry about your ride.. man drunk drivers are everywhere.. when will they learn if it doesnt come down to something like this... and does something like this even stop them from doing it again..

I am actually surprised the insurance is saying it is a repairable car! from the photos, it looks like a total loss. Also, since it is clearly established that it is not your fault, your insurance will claim off the other driver's insurance - so it won't cost them anything!! unless ofcourse both of you are insured by the same company then they'll fork out for both cars and will need to cut their loss to the minimum.

I think they will give me 17OOO euro for the wreck, i think the damage is 12 a 17OOO euro. So i think its touch and go on total loss status. But even if the actual value is not reached a lot of times experts say its not a real loss but a economical loss status. That is if they fear that repairs on first vieuw will not be sufficient to 1OO procent repair, with other words if they fear after repairs the cars engine could show hidden failure break ups or vibrations on the car that you can only test after repairs and not emidiatlly
So i hope they will declear a economical loss if a total loss is not reached.
car was about 5O.OOO euro so i think 2 years will result in a 3O procent decrease in value.
