Confusinon around seating in my '08 on order

That's right - they only move in a crash situation.
I agree with you completely regarding the adjustable upper backrest section on the comfort seats (which is still included on the 2008 comfort seats).
This feature is the main reason that I have decided to go for a 5 series as I only recently discovered it.
I have driven 5 series with both standard and sports seats and found them both to be uncomfortable for the reason you describe - both seats 'slope away' rearwards in the upper back area, giving no support here at all and leaving a 'gap' between your upper back and the seat. If you put the back rests upwards to attempt to rectify, you get too much pressure in the lower back.
I think that this is a major design fault and several road tests that I've read in UK motoring magazines refer to the 5 series being uncomfortable on long journeys.
The poor seating in the 5 series was the sole reason that I went for a 3 series last time as I didn't know that the comfort seats had independent adjustment for the upper backrest section. Now that I've discovered comfort seats, I can get a 5 series at last!
As far as I know, the 5 series failed to get top marks in crash testes due to poor 'pedestrian safety'. I don't know any detail on this though.

Russ1974 was correct about the US. We get 2 choices. Standard 10 way seats in all base models with optional 4 way lumber and optional multi-contour seats (aka comfort seats). The multi-contour seats come with the sport package in all models.

Re the poor rating on headrests, per the IIHS web site, they test with the headrests in the lowest most rear-ward position claiming most people aren't smart enough to adjust them properly. In the E39s I had and the 650i you could manually swivel the headrest forward. I always did. Wit the multi-contour seat, you can't (except for the wings). I adjust the upper back rest to give me more shoulder support and bring the headrests forward some.

That's why BMW went to active headrests in all seats to adjust them forward in a rear accident. Does anyone have pics of a September '07 build or newer with the multi-contour seats? I wonder if they changed as well?

Other than naming convention, is there a difference between "multi-countour 20 way seats" and the Comfort Seat?

So if you are "smart enough" the old comfort seats provide as good of support as the new ones providing you keep it adjusted where there is none/minimal space between your upper back/neck and the cushion behind? That is annoying to describe-not sure of how else to say it.

I literally phsyics wise cannot see any difference providing you do this. So this is for the non comfort seats primarly that cannot adjust this part and people NOT smart enough to figure out you can do this or people who simply do not like doing this for whatever reason
