I bought a 2005 545i with 5K miles as a certified pre-owned vehicle in Dec. 2005. After having the car for a couple of months, I noticed that the rear passenger side quarter panel appeared to have a different paint finish than the rest of the car. I contacted the sales person to ask if the car had ever had any paint or bodywork. The answer I received was not that he knew of.

Today, after washing the car I can see that the paint appears to be oxidizing in that same spot. After closer inspection, I can see over spray on the rubber behind the fuel door.

Does BMW warranty cover the paint if it was repainted as a CPO?

The original warranty should still apply + the used car warranty. Obviously the BMW service people aren't going to be too happy to fix it, but you need to cause some ruckus to get it done if it bothers you that much.

If you make a big fuss about it, you might even be able to exchange for a new car, claiming that this car was repainted and the dealer never disclosed that information to you.

I would not be happy about that paint. If you could find it the "experts" who did the certified pre-owned inspection should have found it. I would raise hell until the paint matches the factory job, especially if you plan on keeping the car for a long period.

I would raise quite a stink too. You paid extra dollars for a "Certified Pre-Owned" vehicle - they always charge more for the CPO cars. I would first express outrage at the fact it was hit and still sold as CPO. They should have found it.

If you're really concerned, I'd start with a demand for an exchange for a new car. If you're not going to lose sleep, demand the entire car be repainted by a mutually agreeable facility.
