I had the same issue. Its a known problem with 535 built before late 07. See SIB 24 03 08
updating the software fixed my problem
SI B 24 03 08
Automatic Transmission May 2008
Technical Service
SUBJECT
E6x, E9x with N54 and 6HP19TU - Jolt and Delay when Pulling Away
MODEL
E90, E92, E93, E60, E61 with N54 and 6HP19TU up to 09/07 production
SITUATION
The customer may complain of a delay engagement and a harsh jolt when accelerating from a stop.
The situation occurs only during the engine warm-up phase (cold engine), and can not be reproduced in the Sport Mode.
CAUSE
EGS software (unfavorable NIC ? Neutral Idle Control calibration)
SOLUTION
On a customer complaint basis only, check the vehicle's integration level.
If the integration level is E89X-07-06-520 (E060-07-03-525 for E6x vehicles) or lower, then reprogram the complete vehicle with a current Progman version (target levels are E89X-07-09-518 or E060-07-09-520 respectively for E9x and E6x vehicles).

tahirsair,
Did you have exactly same problem as Spike from Toronto has (had), that the car jumped/jerked when you released the break padle or was your problem as described in SI B 24 03 08 "delay engagement and a harsh jolt when accelerating from a stop" ?
I have exactly the same problem as Spike from Toronto described with my 535i delivered in July 07. It happens a couple of times per week but only in the morning when the car is cold (been parked all night), it has so far never happened when I go for lunch or leave work in the afternoon (I'm living in Florida so it might not get cold enough in 4 hours for this problem to show up).
