Of course it can. The question is why do you want it reprogrammed? If you simply want an upgrade without having some issue, then yes, the dealer will not update. If you are having some issue then they should update, assuming the car is still under warranty. Saying the car had Sirius indicates you are most likely in the U.S. Maybe if you give us an indication of the issues we can be more helpful...

Oh sorry about that...... The car had a emissions recall and when I called to make an appointment my service guy told me that they could not do it because of the missing Sirius radio due to the fact that while trying to do the update or a diagnostic the process gets stopped by the lack of the sirius module. that was no big deal until the car started to mess up, right now the car idles very rough (the car shakes) the exhaust sounds like it is putting and throttle response just sucks. there is also a warning on the I-Drive and once again my service guy says that he cant do anything for me until the Sirius radio is put back ($1000) or re-wired ($600). Not really in a hurry to take any of those options but I know there has to be another way. That?s why I am here The car is still under warranty and right now I am going back and forth with the service people here at BMW of San Antonio.

I can't believe they can't deactivate the Sirius programming. Is the servicing dealer the same one you bought it from? If so, I'd ask them to remove the programming for Sirius since they sold you the car without the module. If they won't do that, then ask them to install the missing Sirius module...
